Will of Jordan Bailey Holmes County, Mississippi Volume 1 Chancery Clerk 1833 - 1888 In the name of the Divine God Amen!
I Jordan Bailey of the County of Holmes and State of Mississippi being of sound mind and disposing memory do make and
publish the following as my last will and testament hereby revoking all former wills that may have been made by me. Item
1: I will my body to the earth and my spirit to the God who gave it. Item 2: I will and direct that all my just debts be
paid by my executor hereafter named as soon as practicable and also authorize my said executor as soon as practicable to
purchase a suitable monument and tombstone to be placed on my grave. Item 3: Having heretofore given to my daughter
Martha Ann McGaw a considerable portion of my said estate which I value to be worth over a thousand dollars, it is my
will and desire the none of her heirs receive any portion of my estate. Item 4: I give to my son Jno W. Bailey my silver
watch and case of razors, and having heretofore given to my son said John W. in money, property, and otherwise a
considerable portion of my property about $2,000 it is my will and desire that he have nothing of my estate except the
above bequest. Item 5: Having heretofore advanced to my daughter Elizabeth F. Hester in money, land and property about
the sum of fourteen hundred dollars, it is my will and desire that she take nothing of my estate. Item 6: Having
previously given my daughter Abigail O. Green the amount of six hundred dollars in money and property, it is my will and
desire that she have one fifth of the money that may remain after the payment of my just debts and liabilities. Item 7:
Having previously advanced to my son David J. Bailey in money, land and property about Two Thousand Dollars, it is my
will and desire that he take nothing of my estate. Item 8: The rest of real, personal and mixed property I give and
bequeath to my wife C.J. Bailey and my daughters, Mary W., Anna F., and Emma R. Bailey, share and share alike and should
the said Mary W. Bailey desire to have her portion of my real estate set apart to her at any time it is my desire that
the same shall be done and her portion of land being One Hundred & Thirty Acres shall be set off to her and shall be the
following: All lying north of Funneygusha Creek W.W 1/4 Sec 30 W 1/2 SW 1/4 Sec 19 & 41. 50 Acres in the E 1/2 S W 1/4
Sec 19 north of Funnegusha Creek and adjoined to said W 1/2 S W 1/4 & measured by a line running North and South
parallel with the East line of said W 1/2 S W 1/4 Sec 19 all in S. 16 R 3 East & should the said Mary W. die without
issue, it is my will that her interest in my estate [should be given to daughters] Addie F. Bailey and Emma L. Bailey or
the survivor or survivors unless she shall have sold said lands before her death. The property embraced in this Item
includes my property in this state and in the State of Virginia. Item 9: I nominate and appoint my friend A.D. Stark to
execute this my last will and testament and ask that he be not required to give bond. Item 10: I appoint my wife C.J.
Bailey guardian of my minor children Addie F. and Emma L. Bailey and ask that she be not required to give bond as such
guardian. In testimony whereof I have herein to set my hand and seal this 2nd day of Sept., 1878. Jordan Bailey Signed,
sealed and published by the said Jordan Bailey as his last will and testament in our presence who have at the request of
the said JOrdan Bailey subscribe our names thereto as witnesses each of us having subscribed our names here to the same
in the presence of the said Bailey and in the presence of each other: W.F. Cross B.S. Beall H.S. Hooker State of
Mississippi Holmes County Personally appeared before the undersigned Clerk of the Chancery Court of said County and
state, B.S. Beall and H.S. Hooker and W.F. Cross, witnesses to a certain instrument of writing hereto attached and
offered for probate, purporting to be the last will and testament of Jordan Bailey, deceased, who having been first duty
sworn deposeth and with that said instrument of writing was signed, sealed, and published by the said Jordan Bailey in
the 2nd day of September 1878 as his last will and testament in their presence and that they signed the same as
witnesses at the request and in the presence of the said Jordan Bailey and in the presence of each other. That at the
time of making the said instrument as his last will and testament the said Jordan Bailey was more than twenty one years
and of sound and disposing mind and memory and further deponents saith not. Sworn to and subscribed before me this 2nd
day of November, 1887:
