Holmes County
The last will and testament
of Elisha B. Mayfield of said county and state the same being of full age
and of a sound and disposing mind.
Item 1st.
I will that all the expense
of settling up my estate and the executing of this my will be said by
executor herein after to be named
Item 2nd
I will and bequeath to my two
nephews William W. Mayfield and Elisha C. Mayfield in equal portions to
have and have alike all my money notes, accounts or other instances of
debt I may have at the time of my death.
Item 3rd
I will and bequeath to my
said nephews William W. Mayfield and Elisha C. Mayfield in equal portions
to have and share alike all my personal property of all and every kind.
Item 4th
I will and bequeath and
hereby desire unto my two nephews William W. Mayfield and Elisha C.
Mayfield in equal portions to have and share alike all my real estate of
all my real estate of all and every kind. The same to be divided equally
between them as soon after my death as it can convenientyly be done
thereby dividing my lands equally to them.
Item 5th
I hereby appoint my nephews
William W. Mayfield my executor and charge him with the duty of executing
faithfully this my will and having full confidence in the integrity and
faithfulness of the said William W. Mayfield. I desire and direct as my
will that letters testamentary issue from the proper authority to him
without bond as security for the same as my executor. I further will that
my said Executor be not required to file any inventory of my estate or any
schedule of any kind. Nor to make any accounting of final testament with
the courts of the County.
Having this my last will and
testament. I hereby sign my name and affix my Seal this 29 day August
1877.
