To the honorable Reuben Ruff. Judge of the Court of Probate of the County of Noxubee & State of Mississippi

The undersigned, shows, that Elizabeth Tubb, late of said County, departed this life the 31st day of July A. D. 1851 at her residence in this County; that she left her Surviving Twelve children, to wit – Rebecca Williams, who resides in the State of Arkansas, widow of Joab Williams deceased, Lydia Moore, who intermarried with one Alexander Moore, & who also resides in said State of Arkansas, Mary Petty, the wife of Alfred Petty deceased & who resides in said County of Noxubee; Jane Nunn, who intermarried with John Nunn & resides in said County of Noxubee, Sarah Moore, who intermarried with William Moore & who resides in Perry County in the State of Alabama; Elisha F. Tubb who resides in said County of Noxubee; Elizabeth Williams, who intermarried with Job M. Williams & who resides in Louisiana; Susan Tubb who resides in said County of Noxubee, Isabella Ikard, who intermarried with Milton Ikard, who resides in said State of Louisiana; Lucinda Cole who intermarried with Thomas G. Cole, who reside in the County of Choctaw in the said State of Alabama; David A. Tubb of County of Noxubee; & your petitioner; She had also two other children who died before the said Elizabeth Tubb, to wit: Richard Tubb who died in said County of Perry & State of Alabama, leaving a wife & several children, number, names & ages of whom are unknown to your petitioner though some suppose & believe to be over & some under twenty one years of age: and William F. Tubb, who died in said County of Noxubee, unmarried & without children. That said Elizabeth Tubb left three or four slaves, horses, cattle, sheep, hogs, growing crop of corn & cotton, household & kitchen furniture & plantation tools & that she was a widow at the time of her death, that it is necessary & proper for the benefit of said estate & all persons interested that administration be had thereupon forthewith; your petitioner, therefore, being a child of said intestate Elizabeth, and over the age of twenty one years, prays the court to grant him letters of administration upon said Estate, upon his taking the oath, and giving Bond with good & sufficient security according to law, your petitioner furth shows that said Elizabeth Tubb died without leaving any last will and testament, so far as he has been informed, or believes, and that said estate is worth not more than about fifteen hundred dollars. Your petitioner would suggest as appraisers of said Estate Caleb Reed, George L. Haynes, and James Burrage.

The State of Mississippi

Know all men by these presents that we George W. Tubb & Elisha F. Tubb all of the county and State aforesaid are herby held and firmly bound unto Reuben Ruff, Judge of Probate of Said County, and his successors in office in the penal sum of three thousand dollars; which payment, will and truly to be made and done, we bind ourselves, our heirs, executors, and administrators, jointly and several, firmly by these presents, sealed with our seals, and dated this fifth day of August A. D. 1851.

The condition of the above obligation is such, that if the said George W. Tubb Administrator of the goods, chattels, and credits, of Elizabeth Tubb deceased, do make a true and perfect inventory of all and singular the said goods, chattels, and credits of the said deceased, which have or shall come to the hands, possession or knowledge of the said administrator, or in the hand or possessions of any other person or persons for him: and the same so made, do exhibit unto the Probate Court of said County, when he shall be thereunto required by the said court, and such goods, chattels, and credits, as well and truly administer according to law and further do make a just and true account of his actings and doings when thereunto required by the said court; and also the rest of said goods, chattels, and credits, which shall be found remaining upon the account of the said administrator, the same being first duly examined and allowed by the said court, shall deliver and pay unto such persons respectively as are entitled to the same by law. And if it shall hereafter appear that any last will and testament was made by the deceased, and the same being proven in court, and the executors obtain letters testamentary, and the said George W. Tubb __, in such case being required, sender [sic] and deliver up his letters of Administration, then the above obligation to be void, otherwise to remain in full force and virtue.

Note: The year 1852 appears to be incorrect as the appraisement, sale, and return from the sale were completed in 1851 by George W. Tubb.

To all to whom these presents shall come – Greeting:
Know ye that Elizabeth Tubb deceased, late of the County if Noxubee, departed this life Intestate having at the time of her death divers [sic] goods, chattle and credits, within the said State as we are informed in our orphans court of the county aforesaid; we therefore, desiring that the said goods, chattels, and credits, may be well and truly administered and disposed of according to law, do grant unto George W. Tubb full power by the tenor of these presents to administer all and singular the goods, chattels and credits which were of the said Elizabeth Tubb at the time of her death, hereby authorizing and requiring the said Administrator, to demand and recover the same by all legal means to pay all the debts for which the deceased was bound at the time of her death. So far as the said effects will extend and the law charge, one note on H. Patterson $10.00 due 16 April 1849 not ___ ____ $18.00 $1323.25

To Caleb Reed, George L. Haynes & James Burrage
This is to authorize you jointly to appraise the goods, chattels, and personal estate of Elizabeth Tubb late of this county, deceased, so far as the same shall come to your sight and knowledge each of you first having taken the oath hereunto annexed, a certificate whereof you are to return ___ to __ inventory of the said goods and chattels, and personal estate by you appraised in dollars and cents; and in said inventory you are to set down in a column or columns opposite [sic] to each article the value thereof.

Personally appeared before me John F. Denton one of the acting Justices of the Peace, in and for said County, the above named Caleb Reed, George L. Haynes & James Burrage who made oath in due form of law that they will well and truly without partiality or prejudice value and appraise the goods, chattels and personal estate of Elizabeth Tubb deceased so far as the same shall come to their sight and knowledge, and that they will in all respect, perform their duty as appraisers to the best of their skill and judgement.

We the undersigned appraisers do certify that the sheet hereunto annexed contain our appraisement of all the goods, chattles, and personal estate of Elizabeth Tubb deceased so far as the same shall come to our sights and knowledge, amounting to Eleven Hundred & Seventy Six & 35/100 dollars, made agreeable to the above warrant of Appraisement and oath given under our hands and seals this fifth day of September 1851.

To the Honorable Reuben Ruff Judge of the court of Probates of the county of Noxubee & State of Mississippi The undersigned administrators & of the Estate of Elizabeth Tubb decd. Herein reports that by virtue of the order of this court made at the last September Term thereof directing & authorizing a sale of the personal property of said Deceaseds Estate returned to this court in the inventory of appraisement after having given due notice by posting according to the Statute & previous order of this court he did on the 24th day of October A. D. 1851 at the late residence of said deceased in this county between the hours prescribed by law proceed to sell the said personal estate to the highest bidder on a credit of six months from the day of sale and did then and there so expose for sale at public outcry the said personal estate in lots to sevril [sic] purchasers until the same was fully concluded for a full account of which sale with the names of purchasers and the highest amount bid for the same Your administrator refers to the account of sale hereto attached marke A and prayed to be made a part of this report said account of sales amounting in the aggregate to eleven hundred & forty and 75/100 Dollars That said sale was fairly conducted & made and due notice thereof was given and be therefore pray that the sum be received and confirmed all of which is respectfully submitted.
