Probate Court July term A.D. 1847 (looks like 1847, but other
pages say 1849)
In the matter of the estate of Jesse A. Shults,
deceased
It appearing to the satisfaction of the court that Jesse A.
Shults late of this county died some time in
the month of May last without a last will (in this county) and
it also appearing to the satisfaction of the court that the said
decedent died seised and possessed with a small personal estate
in the county and that no person will take letters of
administration on the estate of said decedent, whereupon in
pursuance of the statute in this behalf, it is ordered by the
court, that William L. Duncan, sheriff, of the
county of Tish. and state of Miss. take possession of the estate
of said decedent and that he administer the same according to
law. It is further ordered that letters of administration of
the goods and chattels, rights and credits of the said decedent
of the said sheriff be issued and recorded according to the
statute.
It is further ordered upon motion of the said sheriff that John
F. Arnold, William W. Moore
and Walter A. Patrick be appointed appraisers
to value and appraise the goods, chattels and personal estate of
said decedent and that a warrant be issued in this behalf
according to the statute.
In the matter of the estate of Jesse A. Shults,
deceased
It is ordered by the court that William L. Duncan,
sheriff of Tish. county, Mississippi to whom letters of
administration upon the estate of Jesse A. Shults,
deceased has been granted by this court at the present term
thereof make publication in the Tishomingo Democrat a public
newspaper printed and published in the town of Jacinto in the
county of Tish. Miss. for six weeks successively requiring all
persons having claims against said estate to exhibit the same to
the said sheriff on his successors in office within the time
limited by law on that the same will _____.

In the matter of the application of William S. Duncan,
sheriff of Tishomingo county and of such administrator of the
estate of Jesse A. Shults, deceased for sale of
personal estate.
Upon reading and filing the petition this day prefered by said
William L. Duncan, sheriff and as such adm. the
court being satisfied from the allegations and proofs submitted,
that it is just, proper and expedient, that the sale _____ be
made. It is therefore ordered that the said William L.
Duncan, sheriff and as such adm. as aforesaid have
permission and he is hereby authorized to sell said personal on
a ____ credit of six months from day of sale upon advertising
the time and place thereof in three of the most public places in
this county ninty? days previous thereto and that he sell said
estate at public sale to highest bidder and require, the
purchaser or purchasers to give bond or bonds with approved
security for the purchase money and report? all of his
proceedings in the behalf at the Sept. term of this court.

Shults, deceased, for one years provision.
M.? for reading and filing the petition of Martha Shults,
the widow of the said Jesse A. Shults,
deceased, in her own behalf and that the children of decedent.
It is ordered by the court that John F. _____, William W.
Moore and Walter A. Patrick be
and they are hereby appointed commissioners and directed to
select and set apart out of the stock, provisions on effect of
said decedent, one years provision for the said widow and
children and that they make and return a full report of Heir?
proceedings under and by virtue of this commission, by the next
term of this court.

The honorable B.C. Rives, Judge of the Probate
Court of Tishomingo state of Mississippi the undersigned, widow
of Jesse Shults, deceased would respectfully
state that she does hereby relinquish all of her right and title
to administer upon sale estate which preferum? she is entitled
to by law but for the proper manage must of said estate she
prefers that the sheriff of Tishomingo county Mississippi
according to the statute in this behalf and she is in duty bound
with one pray & c.

In the matter of the settlement of the estate of Jesse A.
Shults, deceased.
William L. Duncan, sheriff and as such adm. of
the goods and chattels, rights and credits of said decedent,
having at this term returned to this court the inventory of the
appraisement appointed to value and appraised the good chattels
and personal estate of said decedent, and the court upon
examination thereof being satisfied that the said appraisers
have in all things proceeded in strict conformity to the law and
that the said appraisement is legally made out and certified it
is thereupon ordered that it be and the same is hereby approved,
confirmed and ordered.

In the matter of the application of Margarett Shults,
the widow of Jesse A. Shults, deceased.
On reading and filing the report of W.A. Patrick,
William W. Moore and John F. Arnold,
the commissioners appointed by this court to select and set
apart from the stock of provisions and effects of said decedent
one years provisions for the said widow and the children of
decedent, the court having this day, examined and approved said
report _____ order that the same be in all things confirmed and
that William L. Duncan sheriff and as such
administration of the goods, chattels and rights and credits of
said decedent ____ comply with the same by delivering over to
the said widow, the provisions and by paying to her the money
set apart for her use, by said commissioners and that ____
himself therewith in his next settlement with the court.

deceased
On reading and filing the report of William L. Duncan,
sheriff and as such administrator of the estate of Jesse A.
Shults, deceased, this day returned wherein he
reports, that in pursuance of the order and decree of this court
made at the last term thereof directing a sale of the personal
estate of said deceased he has made said sale and it appearing
to the satisfaction of the court, on examination of the proofs
and exhibit 5 accompanying and filed with said report, that the
said adm. has been in all things complied? with the statute in
this behalf and that the said sale has been legally made,
conducted and concluded. It is therefore ordered that the same
be in all things approved and confirmed and that said report and
exhibits be filed and recorded.
