Holcut Road
District Commissioners Named, 1920

The
commissioners of the Holcut Road District met in the office of
Bennett & Clark, attorneys on the 4th day of February, 1920,
there were present W.W. Bingham, president of the commissioners
and R.E. Strickland, secretary, John Moore being absent.
The following
business was transacted to-wit:
The
commissioners employed Charles A. Hardie as Civil Engineer for
the said district and entered into contract as follows: (note
the following information is typed onto letterhead that reads, "Holcut
Supply Co., General Merchandise and Produce, Holcut, Miss.

This contract
made and entered into this the 4th of February 1920 by and
between W.W. Bingham, R.F. Strickland, and Jne Moore,
Commissioners for the HOLCUT ROAD DISTRICT FOR and on behalf of
the HOLCUT ROAD DISTRICT, hereinafter called party of the FIRST
PART, and Charles A. Hardie, CIVIL ENGINEER hereinafter called
party of the SECOND PART WITNESSETH:
That said
party of the first party hereby employs said part of the second
part as ENGINEER for the Holcut Road District of said County as
they have authority to do under the provisions of Section 5,
Chapter 176, Laws Miss, 1914, to survey and lay out such road or
roads in said Holcut Road District as the said party of the
first part shall determine upon. The engineer shall make an
estimate of the cost of constructing and maintaining such
highway or highways for each separate mile covered by such
survey and report such survey and estimate to the said party of
the first part; the said party of the first part hereby agrees
to pay the said part of the second part out of the proceeds of
the sale of the bonds of the Holcut Road District the sum of
$50.00 per mile for the survey where the same follows an old
roadway, and 20% additional for such part of the survey as might
go through woodland, said amount to include up to, and including
the letting of the contract. For the super! vision of the said
road or roads after contract let the said party of the first
part is to pay the said party of the second part 4 1/2% of the
actual cost of construction.
Said party of
the second part is to give Bond in the sum of ONE THOUSAND
DOLLARS payable to party of the first part for the faithful
performance of his duty, the premium of which will be paid out
of the funds of the HOLCUT ROAD DISTRICT.
It is hereby
agreed and understood between the party of the first part and
the party of the second part that 15% of the amounts that may be
due the party of the second part shall be retained until the
roads are finally accepted by the Road Commissioners and Board
of Supervisors.
It is hereby
agreed and understood between the party of the first part and
the party of the second part that all that part of Chapter 176,
Laws of Mississippi, 1914, relative to Engineer and his duties
are made as much a part of this contract as if the same were set
out in full in this contract.

our hands this the 4th day of February 1920.
