This deed of trust made this the 1st day of October 1875, witnesseth that
whereas Hugh B. McCoy of Newton County State of Mississippi party of the
first part is indebted to A. McCoye of Scott County, Mississippi, in the
sum of $172.50 dollars on ? for Rent and supplies furnished during the
year 1875, Whereas said party of the first part expects said party of the
said party, to advance $50 in money and supplies during the year 1875, and
whereas said agreed to secure the payment of said sum as also any amount
that may be advanced as aforesaid that the party of the first in consideration
of the premises as well as for $10, to him paid by James A. Ware, trustees do
thereby bargain, sell and convey,to said trustee the property, being in Newton
and Scott County, Mississipi and described as follows. His ? corn and cotton
crop to be grown by the party of the first part during the year 1875- present
year, the cotton to be delivered as fast as it can be gathered and prepared for
market, and sold to or by then. And proceeds of sale applied to payment of
this deed of trust and what balance may be due said Hugh McCoye at the time
of sale and balance of proceeds if any to be paid over to the party of the
first part. The title to which unto said trustee any successor, I warrant,
and agree forever to be deferred in trust however that if said party shall
on or before the first day of December 1875 pay what may be and A. McCoye as
aforesaid and all costs incurred on ? of this deed then this deed to be void,
but if default is made in said payments the trustee shall take possession of
said property,and having given ten days notice of the time place and terms
of sale, by publication in some newspaper or posting a written advertisement
in three public places in the said county of Newton sell said property as a
sufficiency thereof to make said payment for cash at public auction, at Lake
in Scott County, State of Mississippi. And the said C ? A? McCoye & Hugh
McCoye or their legal representative can at any time they desire appoint a
trustee in the place of J.A. Ware or any succeeding trustee, and should the
trustee at any time before said property or buy part thereof endangered as
security for said payments he shall take the same in his possession and
hold until said payments are made or property is sold as aforesaid but
until demanded by the trustee for either of the purposes aforesaid said
party of the first part can keep the same.

Personally came before me the undersigned a Justice of the Peace
in and for said county within named H.B. McCoye, who acknowledged that
he signed sealed and delivered the foregoing deed, for the purposes
therein expresses as his act and deed. Under my hand
and seal this 4th day of October A.D. 1875
