AN ACT to divide the county of Jasper into two Circuit and Chancery Court Districts, and to fix the jurisdiction of the Courts, and to provide for holding same in each district, and to locate the county seat in the Second District therefore, in the town of Bay Springs, and to provide for the building of a courthouse and jail therein, and for transcribing all muniments of title of lands lying within the Second District of said county, and to provide for the payment of all expenses incurred in carrying out the provisions of this Act.
Creating new Court District in Jasper County.
Section I. Be it enacted by the Legislature of the State of Mississippi, That for the purpose of creating two Circuit and Chancery Court Districts in the county of Jasper, said county shall be divided into two districts, to be called the First and Second Circuit and Chancery Court Districts of Jasper County, and the Circuit Court for the First District thereof shall be held at the courthouse in the town of Paulding in said county on such days and for such time as the Legislature may from time to time provide. The Circuit Court of the Second District of said county shall be held at the courthouse or such other place as the Board of Supervisors may select in the town of Bay Springs, on such days and for such time as the Legislature may from time to time provide. The Chancery Court for the First District of said county shall be held at the courthouse in the town of Paulding in said county and on such days and for such time as the Legislature from time to time may provide; and the Chancery Court of the Second District of said county shall be held in the town of Bay Springs, in said county, at the courthouse therein or such other place as the Board of Supervisors may provide, on such days and for such time as the Legislature may from time to time provide. Sec. 2. The following described lines shall be the line of division between the First and Second District of the said Jasper County, to wit: Beginning at that point on the northern boundary line of Jasper County where the range line between Ranges 11 and 12, east, crosses same and running south along said range line to the base line, thence south from the northwest corner of Section 4, Township 10, Range n, west, running with the section line to the southwest corner of Section 21, Township 10, Range u, west, to the southern boundary line of said county and all of that portion of Jasper County lying west of said line shall be and constitute the Second District thereof, and all that portion of Jasper County lying- east of said line shall be and constitute the First District thereof. Sheriff to keep an office in each district.
Sec. 3. The Sheriff of Jasper County shall be the proper officer to execute all process required by law to be executed by the Sheriff and to return the same to such districts of said county as the same may belong. He shall keep an office at Bay Springs and one at Paulding, and in each of said offices he shall keep all of the books, records and documents required by law to be kept by Sheriffs in every county in this State, the same as if said two districts were separate counties. In making sales of land under execution or otherwise in the discharge of any of his official duties, such lands as lie in the First District he shall sell at the door of the courthouse at Paulding, and in making like sales of land lying in the Second District he shall sell the same at the door of the courthouse at Bay Springs. Sales of personally made by the Sheriff under like authority shall be made at such places in each district as the law shall direct, as if each were a separate county. Clerks to keep offices in each district.
Sec. 4. The Clerks of the Circuit and Chancery Courts of said county shall be the Clerks of the respective Circuit and Chancery Courts in each of the districts aforesaid, and shall keep offices both at Paulding and Bay Springs, in which all books, records, dockets. papers and documents belonging to each of the courts of said districts shall be kept respectively, and all the dockets, records, papers and books required by law to be kept by Clerks of the Circuit and Chancery Courts in this State shall be kept by each of said Clerks respectively at Paulding and at Bay Springs for each of said districts, and the enrollment of a judgment or decree in the district, where the same shall be obtained or rendered, shall be a lien on all property of the person against whom the same may be rendered, within the district where so enrolled. Chancery Clerk to provide separate records for the new district.
Sec. 5. Hereafter it shall be the duty of the Chancery Clerk of Jasper County to keep in his office at Bay Springs suitable record books for the purpose of recording deeds, deeds of trust and other conveyances, instruments and contracts required by law to be recorded, and all deeds, deeds of trust, mortgages, contracts, wills and other conveyances and contracts and all muniments of title, documents or other papers required by law to be filed, enrolled or recorded relating to property situated in said Second District, and which, but for this Act, would be properly filed, enrolled or recorded in books kept by said Clerk in his office at Paulding, shall be properly filed, enrolled or recorded in the office of said Clerk at Bay Springs, in books kept for that purpose in his said office at Bay Springs, and when so filed, enrolled or recorded the original record or proof thereof, or duly certified copies thereof, from the said record, shall have the same force and effect in law that they would now have if enrolled, recorded or filed in the office aforesaid at Paulding. All official bonds shall be recorded by said Clerk as required by law, in the office of the said Clerk at Paulding and at Bay Springs. Circuit Clerk to provide separate records for the new district.
Sec. 6. Hereafter it shall be the duty of the Clerk of the Circuit Court of Jasper County to keep in his office at Bay Springs all the records, record books and documents of every character which he is now required by law to keep in his office at Paulding, and said records, books and documents, or duly certified copies thereof, shall have the same force and effect in law that they would have if said books, records and documents had been kept or preserved by him in his office aforesaid at Paulding.
