Last Will and Testament of M.G. CUMBY, deceased

Know all men by those presents that I, M.G. CUMBY a citizen of the county and state aforesaid do make publish and declare this to be my last will and testament and dispose of my effects as follows:
1st. I will that all my just debts and funeral expenses be paid.
2nd. I give devise and bequeathe to my son James M. CUMBY the west half of the northeast quarter of section Ten (10) in township Two (2) of Range Eight (8) east and situated lying and being in Alcorn County, State of Mississippi.
3rd. I give, devise and bequeathe to my daughter Amanda BURKE the east half of the North West quarter of Section (10) Township Two (2) of Range Eight (8) East, situated in the County of Alcorn (marked out) and State aforesaid with the understanding that should I depart this life before my wife Elizabeth CUMBY, that she is to live on, control and be possessed of Said E 1/2 of N.W. 1/4 Sec. 10 T2 R8 East and all benefits arising from the same during her natural life, it being my Homestead where I now reside; it is my desire that my daughters live with my said wife in the event of my decease first, and care for her Mother, then it is my will that said E 1/2 of N.W. 1/4 Sec. 10 T 2 R 8 East belong absolutely to my daughter Amanda BURKE.
4th. My personal effects are not much; and I desire that should I depart this life before my wife Elizabeth CUMBY, that she shall use and control all my personal effects as she deems best, should my wife depart this life before I do, then what personal effects I may leave, I will that my son James M. CUMBY and my daughter, Amanda BURKE divide my personal effects equally between themselves, being satisfied they will not disagree, but will treat each other right, they can dispose of my personal effects as they deem best.
5th. I nominate, constitute and appoint my son James M. CUMBY my executor to execute this my last will and testament, and I desire that he act without and be not required to give Bond being satisfied that he will do right, and I further desire that he be not required to file any inventory or appraisement of my Estate, and that he be not required to make any annual report, as I do not deem it necessary.
In witness whereof, I hereunto set my hand and declare this to be my last will and testament this the 27th of May 1896.
