Sir:  The evidence in support of your claim, under the act of June 7, 1832, has been examined, and the papers are herewith returned.  The following is a statement of your case in a tabular form.  On comparing these papers with the following rules and the subscribed notes, you will readily perceive that objections exist, which must be removed, before a pension can be allowed.  The notes and the regulations will show what is necessary to be done.  Those points to which your attention is more particularly directed, you will find marked in the margin with a brace, (thus -}).  You will, when you return your papers to this Department, send this printed letter with them, and you will, by complying with this request, greatly facilitate the investigation of your claim.

THE STATE OF MISSISSIPPI, ] IN THE CIRCUIT COURT
SIMPSON COUNTY.                       ]                                 AT OCTOBER TERM 1832
 
DECLARATION IN ORDER TO OBTAIN THE BENEFIT OF THE ACT OF CONGRESS PASSED JUNE THE 7TH 1832
 
On this the fifteenth day of October in the year of our Lord one thousand eight hundred and thirty-two (1832) personally appeared in open court before the honorable Edward Turner, presiding judge of the Second Judicial Circuit of the State of Mississippi, and now holding the October Term 1832 of the Circuit Court of the said County of Simpson and State aforesaid, now sitting, JOHN DURDIN, a resident of the said County of Simpson and State aforesaid, aged seventy (70) years, who being first duly sworn according to law, doth on his oath make the following declaration in order to obtain the benefit of the Act of Congress passed June 7th 1832:
 
That he, the said JOHN DURDIN, entered the service of  ______(UNITED?) States about the year 1778 as a volunteer commanded by Captain Williams under Gen’l Richard Caswell in which campaign he served three months or more.  That he was afterwards drafted and went out and served another tour of three months under Richard Caswell, Junior and under a Lieutenant Pitman.  That he was frequently called out and went out to defend the Country in times of excitement or danger.  That he was out in the service at different times but so long ago that he has forgotten where he marched or the names of his officers.  That he is confident he was engaged in the said service in all more than one year, probably between one and two years.  That he recollects of marching during said service to Newburntown (New Bern town) in North Carolina, thence to Wilmington where they built a fort.
 
That he was born, and at that time resided in Daubs (Dobbs) County in the State of North Carolina.  That he stood as a Minuteman a great part of the Revolutionary War, ready to go into the service when called on.  He was in the service when the British marched through North Carolina & was at that time in another command of Cap’t. Williams, Lieutenant Pitman and Gen. Caswell.  That he recollects that young Caswell was taken by what was called the SUSKS … LUSKS LUSK ???.  That he continued in said service until about the ____CLOSE_? Of the war.  That he recollects the names of Lieutenant Wardell (Waddell??) and Insign Smith with whom he served.  That he was born at the place above stated but has no record of his age.  Lived Daubs (Dobbs) County, North Carolina when called into the service and have since lived in the State of Louisiana and the State of Mississippi.

That he, the said JOHN DURDIN, has no documentary evidence and that he knows of no person whose testimony he can procure who can testify to his service.  And that he hereby relinquishes every claim whatever to a pension or annuity except the present and declares that his name is not on the pension roll of the agency of any State of the Union.
