To the Honorable Reuben Ruff Judge of the Probate Court of Noxubee County
Mississippi:
The Petition of Samuel S. Kelly Administrator of Charles Ferguson
deceased shows that on the 2nd day of January AD 1842 he reported or
returned a bill of the sale of the personal property of the estate of said
Ferguson to this court amounting to $1,712.47. At the same time he reported
the amount due said estate in notes to be $577.22. These two items added
together show that the assets of said estate at the date refered (sic) to
amounted to the sum of $2,289.69. Subsequent to that time he sold a crop of
cotton belonging to said estate for which he received $683.09 and also the
land belonging to said estate situated in the State of Mississippi at the
sum of $1,500.00. The return of the cotton was made on the 3rd day of April
1843 and the land on the 1st day of April 1844, these two last items added
to the amount reported 2nd January 1842 show that the asset of said estate
at the date of the last return above referred to amounted to the sum of
$4,372.78, from this amount is to be deducted one seventh of the amount of
the cotton as the share of John Chandler and negroes.
The report made 1st April 1844 shows that he charged himself with $666.00
as money received for debts due for the sale of personal property, this
unexplained would induce the belief that he had received that amount in
addition to the sale bill or the amount of assetts reported previous to the
date of the said last mentioned return. But such is not the fact. The
$666.00 charged against him in the return made 1 of April 1844 is the amount
that he had collected up to that time of the assetts of the estate and that
had been previously reported. Again the proceeds of the sale of the cotton
crop were reported 3rd of April 1843, and this item is through mistake
corrected into or included in another report made on the 7 July 1845. So
that the records show that he is charged with the cotton twice when in truth
he should be charged with it only once. Deduct one seventh from the amount
for which the cotton sold as the share of John Chandler and negroes in the
cotton and which should not have been returned as part of the assetts of the
estate being $97.58 and the returns heretofore made will show the amount of
assetts to be $4,275.20. In the annexed return he has charged himself with
$1,101.00 collected since the former return was made or not heretofore
reported. The negroes of said estate with excetion of two that was given by
the will of said Ferguson to his daughter Synthia were appraised at $6,475.00
and divided amongst and delivered to the heirs whose receipt for the said
negroes was upon record in this court.

appraised.]
