Charles Powell Deeds

James A. GRIMES to Charles POWELL.  Transcribed by Jan Lawson.

 

"This Indenture made and entered into the 30th of October one Thousand Eight hundred and forty six by and Between James A. GRIMES of the one part and Charles POWELL of the other part all of the County of Lafayette and State of Mississippi, Witnesseth, that James A. GRIMES hath this day for and in consideration of the sum of Three hundred and thirty dollars current money, the receipt whereof is hereby acknowledged, bargained sold aliened & confirmed unto Charles POWELL their heirs & assigns forever all right title claim & interest to a certain tract or parcel of land lying & being in the bounds of the cession of the Chickasaw Indians to the United States & in the County & State aforesaid known as the North West quarter of Section No. Six in Township No. ten of Range No. one West Containing one hundred & sixty and 2/100 acres and the tract designated as the North half of the North East quarter of Section one Township ten Range two West containing Eighty acres more or less and the title of the same we hereby bind ourselves our heirs executors and Administrators [and] doth hereby warrant and defend the title of the said tract or parcel of land against the claim or claims of all and every person or persons whomsoever in witness whereof I hereunto affix my hand and seal the day and year above written."  Signed:  James A. GRIMES (seal).  Test: Willis PATTERSON.....Certification:  The State of Mississippi, Lafayette County.  "Personally appeared before me Willis PATTERSON an acting Justice of the Peace in and for said County James A. Lafayette Co., MS. Deed Book G, pgs. #180 - #181.  AMBERT MORELAND to Charles POWELL.  Transcribed by Jan Lawson. 

 

"This Indenture made and entered into this 21st day of February A. D. 1853 between Ambert MORELAND of the first part and W. G. VAUGHAN of the Second part both of the County of Lafayette and state of Mississippi, that the party of the first part for and in consideration of the Sum of Two hundred and Seventy five Dollars the consideration herein after mentioned doth grant bargain & sell to the party of the second part the following described land, to wit, the North East quarter of Section Sixteen in Township ten of Range one West of the basis Meredian of the Chickasaw Cession containing one hundred and sixty acres more or less.  In Trust nevertheless for the following purposes which is the consideration before mentioned that is to say Charles POWELL hath this day loaned the said party of the first part two hundred and Seventy five Dollars due the 25th of December 1853 and if the said party of the first part fails to pay the said money by the 25th of December 1853 then the said W. G. VAUGHAN is hereby authorized and empowered to sell the land aforesaid at public auction at the Court House Door in the Town of Oxford after giving thirty day notice of the same by advertisement Posted up at the Door of the Court house and at three other public places in said County and from the proceeds of said sale, if anything remains in the hand of said VAUGHAN after saving himself of the Sale of said Land and the Expense of this Deed the sale and Commission, so it is to be paid over to the said MORELAND and it is further agreed that the said MORELAND is to remain in possession of the said premises until the day of sale [at] which time he is to surrender possession to its purchaser and the said VAUGHAN is to convey the title to the said land to the purchaser or purchasers by deed.  In testimony whereof the said party of the first part have hereunto Subscribed his name and affixed his seal the day and date above Written."  Signed: A. (his x mark) MORELAND (seal). Witness: W. G. VAUGHAN .....Certification:  The State of Mississippi, Lafayette County.  "Personally appeared before me W. G. VAUGHAN clerk of Probate Court of said County the above named A. MORELAND, who acknowledged that he Signed sealed and delivered the within and foregoing Deed of Trust on the day and year within mentioned as his act and deed for the purposes therein Expressed.  Given under my hand and the seal of said Court at office this 21st day of February A. Lafayette Co., MS. Deed Book G, pg. #230.  Charles POWELL and Permelia POWELL to Noah RAYBURN.  Transcribed by Jan Lawson. 

 

"This Indenture made and entered into this the 12th day of March One thousand Eight hundred and fifty three by and between Charles POWELL & Permelia POWELL his wife of the one part and Noah RAYBURN of the other part all of the County of Lafayette and State of Mississippi.  Witnesseth, the said party of the first part have this day for and in consideration of the sum of fifty Dollars in hand paid the receipt whereof is hereby acknowledged that he bargained sold granted all the right title and interest to the party of the second part his heirs and assigns, the East half of the North East quarter of Section No. 20 of Township No. 10 of Range No. 1 West of the Basis meredian Containing Eighty acres (more or less).  In witness whereof we have hereunto affixed our hands and seals this day and year above written."  Signed:  Charles POWELL (seal) and Permelia (her x mark) POWELL (seal).....Certification:  State of Mississippi, Lafayette County.  "Personally appeared before me P. A. VANCE an acting Justice of the Peace in and for said County Charles POWELL and Permelia POWELL who acknowledged that they signed sealed and delivered the within Deed for the purposes therein mentioned and Permelia POWELL on a private Examination apart from her husband acknowledged that she signed sealed and delivered the within Deed without any fear threat or compulsion of her said husband.  Given under my hand and seal this the 12th day of March A. D. 1853."  Signed:  P. A. VANCE, Justice of the Peace (seal).

"This Indenture made and entered into this Seventh day of February One Thousand Eight Hundred and fifty four between John DUNCAN of the first part and Charles POWELL of Lafayette County of the Second part all of the State of Mississippi.  Witnesseth, that the said John DUNCAN hath this day for and in consideration of the sum of Six Hundred and Sixty Two Dollars fifty cents in hand paid the receipt whereof is hereby acknowledged that he bargained Sold granted released conveyed and confirmed and by these presents doth bargain Sell grant release and confirm unto the said Chas POWELL his heirs Executors or Administrators or assigns forever a certain piece tract or parcel of Land known and designated as the South West quarter of Section Sixteen in Township Ten of Range One West of the basis meredian of the Chickasaw survey containing one Hundred and Sixty acres more or less and the said John DUNCAN for the better security of the Title and Interest ___ tract or parcel of land hereby granted Sold released conveyed and confirmed unto the said Charles POWELL his heirs and assigns forever doth hereby warrant and will defend the title of the said tract or parcel of Land against the claim or claims of every person or persons whomsoever.  In witness whereof I hereunto affix my hand and Seal the day and year above written."  Signed:  John DUNCAN (seal).

"Know all men by these presents that we Charles POWELL & Permelia POWELL his wife have this day bargained and sold and by these presents do bargain and sell all of their right title and interest for and in consideration of the sum of one hundred & fifty Dollars, to them in hand paid the receipt whereof is hereby acknowledged, to John HIPP the following tract or parcel of land, the West half of the North East quarter of Section twenty Township ten Range one West containing Eighty acres more or less according to the Chickasaw Survey and lying in the County of Lafayette and State of Mississippi.  In testimony whereof we have hereunto set our hands and seals this the 8th day of March A. D. 1854."  Signed:  Charles POWELL (seal) and Permelia POWELL (seal).....Certification:  State of Mississippi, Lafayette County.  "Personally appeared before me G. H. HARTSFIELD an acting Justice of the Peace in and for said County Chas POWELL and Permelia POWELL his wife who acknowledged that they signed sealed and delivered the within Deed for the purposes therein mentioned, And Permelia POWELL on a private Examination apart from her husband acknowledged that she signed sealed and delivered the within Deed without any fear [or] threats of her husband.  Given under my hand and seal this the 17th day of March A. D. 1854."  Signed:  G. H. HARTSFIELD, Justice of the Peace (seal).
