Last Will and Testament of Webster Gilbert 1846

The State of Mississippi             } 

Copiah County             )  Knowing that this mortality shall soon find an immortality and that this body that is now known shall soon be known no more forever, I now commit my soul to God and my body to the tomb.

 

            Know all persons by these presents greeting, that I Webster Gilbert of the county and state aforesaid him possessed of my proper mind and intellectual faculties do this day make my last will and testament to wit: I do give and bequeath to my beloved wife Hannah Gilbert, all my estate both real and personal to have and to hold the same unmo- listed (after paying my just debts) during her widowhood, or provided she never marries, to have and to hold the same her life time, and then to be sold to the highest bidder at public auction and the proceeds of the same to be equally divided among my several children to them to have and to hold the same to them and their heirs forever. 
And I do hereby appoint Wm. W. Martin sole executor of the same.  In testimony whereof I have this day signed sealed, and delivered the same.

The State of Mississippi}                  In Probate Court of

Copiah County    }                      said County Sept. Term AD___

In the matter of a certain instrument of writing purporting to be the last Will and testament of Webster Gilbert, Deceased.

Be it remembered that at a term of the Probate Court of the County of Copiah in the State aforesaid begun and held at the Court House in and for said County on the 1st Monday in September AD 1860, personally appeared in open Court E.R. Applewhite, Seth Applewhite subscribing witnesses to a certain instrument of writing purporting to be the last Will and Testament of Webster Gilbert deceased dted August 22nd 1846, who having been first duly sworn, deposed and said that the said Webster Gilbert signed, sealed, published and declared said instrument as his last will and testament I the presence of these deponents on the day of the date thereof, that said testator was then of sound disposing mind and memory and more than twenty one years of age and that these deponents subscribed said instrument as witnessseth thereto at the instance and request and in the presence of each other on the day and year aforesaid, and also I the precence of James b. Crawford, one of the subscribing witnesses, who has since said signing departed this life, & the said E.R. Applewhite one of the witnesses to said will further deposes & says that he signed said J.B. Crawford’s name to said instrument of writing at his request as a witness thereto & in the presence of the testator & in the presence of the subscribing witnesses.
