59        In the matter of the application of R.B. Gilbert heir at law of Webster Gilbert deceased to have an order for the allotment of dower to the widow of said decedent Hannah Gilbert.

            On reading and filing the petition of said R.B. Gilbert for admeasurement and allotment of dower out of lands tenements and hereditaments of which the said Webster Gilbert died seized and possessed.  It appearing to the satisfaction of the Court that all parties in any manner interested in said real estate have waived notice in writing of the pendency of said petition and consented that the Court may make the order for admeasuring and allotting the said widows dower.  And it being represented to the Court in said petition that said Webster Gilbert died seized and possessed of the following described tract or parcel of land situate lying and being in said County to wit, the South half of the southwest quarter and the South west quarter of the South East quarter of Section five and the North East quarter of Section eight, the North half of the North East quarter and the North half of the North west quarter and the South East quarter of the North West quarter, & the South west quarter of the North East quarter of Section nine all of Township eight Range Six East.  It is thereupon ordered adjudged and decreed and his honor does order adjudge and decree that a writ of dower forthwith issue directed to the Sheriff of this County commanding him to summon three discreet free holders as commissioners not connected with the parties consanguinity or affinity and entirely disinterested which said commissioners after being sworn by said Sheriff shall allot and set off by metes and bounds to the said Hannah one third part of the lands tenements and hereditaments above described according to quality and quantity comprehending the dwelling house in which the said Webster in his lifetime and next before his death was most accustomed to reside together with the buildings offices and houses and other improvements thereunto belonging or appertaining and the said Sheriff shall put the said Hannah in possession thereof said land so allotted to vest in her during the term of her natural life, and that the said Sheriff return said writ together with the report of said commissioners duly certified to a subsequent term of this Court.  Ordered adjudged and decreed this 3rd day of June AD 1867.

60        In the matter of the petition of R.B. Gilbert for Division of the real estate of Webster Gilbert deceased.

            On reading and filing the said petition it appearing to the satisfaction of the Court that the said R.B. Gilbert is one of the heirs at law of said Webster Gilbert & W.F. Gilbert deceased and that he is now of lawful age to claim a division of said real estate and it also appearing to the satisfaction of the Court that D.W. Gilbert, N.A. Watson and her husband William A. Watson, Lauanza Jane Davis and her husband W.W. Davis and Hannah Gilbert heirs and distributes of said decedents have waived notice in writing of the pendency of said petition and consented that the Court might act in the premises.  It is thereupon ordered by the Court that Joeseph E. Chiles, Robert Hamilton, Seth Applewhite, Eldridge Applewhite and Davis Applewhite disinterested freeholders of this County be appointed commissioners and as such they are hereby ordered and directed to divide the said real estate mentioned in said petition excepting the dower of the said Hannah Gilbert therein agreeably to the laws of descents and to allot and set apart each heirs share thereof and that they make and return under oath a full report of their proceedings under this order at a subsequent term of this Court.

            Ordered adjudged and decreed this the 3rd day of June AD 1867.  M.H. Peyton Judge of Probate & c.
